Terms and Conditions

Definitions: In these Terms and Conditions of Sale, "Seller" means All-Seasons Comfort, LLC; "Buyer" means the person, firm, company or corporation by whom the order is give.
Service Quotation: Prior to providing services the seller and buyer shall agree on the terms of the estimate and scope of work.  Should substantial changes occur in the scope of work while fulfilling the original agreement a revised estimate must be agreed before continuing.  Seller shall use best efforts to complete the order as expediently as reasonably possible.
Quotation Term: Written quotations are valid for 30 days unless and alternative period is agreed to by the seller at the time of quotation. The Seller reserves the right to resend any quotation at anytime prior to the acceptance of the buyer. Seller reserves the right to effect minor modifications and/or improvements to the Goods before delivery provided that the performance of the Goods is not adversely affected and that neither the Contract Price nor the delivery date is affected.
Equipment Orders: In the event the Buyer agrees to purchase equipment or supplies needed to fulfill their order and then subsequently declines to accept any or all of the equipment or supplies the Buyer shall be responsible for the return and restocking fees assessed by the equipment or supplies vendor.
Payment: Payment in full is due upon completion of services unless prior arrangements have been agreed to by the seller. Cash, checks, debit cards and all major credit cards (Visa, MasterCard, American Express and Discover)are acceptable forms of payment.
Force Majeure: Force Majeure of any kind, unforeseeable production, traffic or shipping disturbances, war, acts of terrorism, fire, floods, unforeseeable shortages of labor, utilities or raw materials and supplies, strikes, lockouts, acts of government, and any other hindrances beyond the control of the party obliged to perform which diminish, delay or prevent production, shipment, acceptance or use of the goods, or make it an unreasonable proposition, shall relieve the party from its obligation to supply or take delivery, as the case may be, as long as and to the extent that the hindrance prevails. If, as a result of the hindrance, supply and/or acceptance is delayed by more than eight weeks, either party shall have the right to cancel the contract. Should the Seller’s suppliers fail to supply him in whole or in part, the Seller shall not be under obligation to purchase from other sources. In such cases, the Seller shall have the right to distribute the available quantities among his customers while at the same time taking into account his captive requirements
Limitation of Liability: Supplier's maximum aggregate liability for any and all losses, liabilities, expenses (including legal expenses), damages, claims or actions incurred under or in connection with a specific order shall in no circumstances exceed a sum equal to the total price of the Order.
Confidentiality and Privacy: All-Seasons Comfort, LLC is committed to honoring the privacy of our customers and of visitors to our website. We only collect personally identifiable information with your consent. Personally identifiable information is information that identifies you or that can be used to identify you or to contact you, physically or online. This information includes: your name, your email address, your address, your telephone number, your address and your credit card number. It is possible for you to visit our website without providing any personally identifiable information. All-Seasons Comfort, LLC does not sell or share your personally identifiable information to others. To review or change your personally identifiable information stored in your account, you must contact All-Seasons Comfort, LLC, in writing (email is fine). We will verify the identity of the requestor prior to releasing any personal information.
